By accessing or using Sabah Business Hub, you agree to be bound by these Terms & Conditions and our Privacy Policy. If you do not agree, you must not use the Platform.

Dengan mengakses atau menggunakan Sabah Business Hub, anda bersetuju untuk terikat dengan Terma & Syarat ini dan Dasar Privasi kami. Jika anda tidak bersetuju, anda tidak boleh menggunakan Platform ini.

3. What the Platform is (and is not)3. Apa itu Platform ini (dan apa yang bukan)

Sabah Business Hub is an online business directory for the state of Sabah, Malaysia. The Platform:

• Is a directory that lists business information for discovery and contact purposes.
• Is not a marketplace, e-commerce platform, or transactional intermediary. We do not facilitate, process, or take any part in transactions between you and any listed business.
• Is not a recommendation, endorsement, or guarantee of any listed business's quality, legality, safety, or suitability.
• Is not a substitute for your own due diligence before engaging with any business.

Sabah Business Hub ialah direktori perniagaan dalam talian untuk negeri Sabah, Malaysia. Platform ini bukan pasaran, platform e-dagang, atau perantara transaksi. Kami tidak memudahkan, memproses, atau mengambil bahagian dalam sebarang transaksi antara anda dan mana-mana perniagaan yang disenaraikan. Platform ini bukan pengesyoran, sokongan, atau jaminan kualiti, kesahihan, keselamatan, atau kesesuaian mana-mana perniagaan yang disenaraikan.

4. User eligibility and accounts4. Kelayakan pengguna dan akaun

• You must be at least 18 years of age to create an account or claim a business listing.
• You may hold only one account per person.
• You are responsible for maintaining access to the email address associated with your account (used for magic-link sign-in).
• You are responsible for all activity that occurs under your account.

Anda mesti berumur sekurang-kurangnya 18 tahun untuk membuat akaun. Anda hanya boleh mempunyai satu akaun setiap orang. Anda bertanggungjawab untuk mengekalkan akses kepada alamat emel yang dikaitkan dengan akaun anda dan untuk semua aktiviti yang berlaku di bawah akaun anda.

5. Business listings and accuracy5. Penyenaraian perniagaan dan ketepatan

Seeded listings: Some listings on the Platform are created from publicly available data sources (including OpenStreetMap). These listings may contain AI-generated descriptions. We make reasonable efforts to ensure accuracy but do not guarantee that any information in a seeded listing is complete, current, or accurate.

Claimed listings: When a business owner claims a listing, they take responsibility for the accuracy of the information displayed. By claiming a listing, you warrant that:

• You are the owner of that business, or are authorised by the owner to manage the listing.
• All information you submit is truthful, accurate, and not misleading.
• Your content does not infringe any third party's intellectual property, privacy, or other rights.
• Your content does not contain any unlawful, defamatory, obscene, or harmful material.

We reserve the right to remove or suspend any listing that violates these terms, is fraudulently claimed, or is the subject of a legitimate dispute.

Sesetengah penyenaraian dicipta daripada sumber data awam dan mungkin mengandungi penerangan yang dijana AI. Kami tidak menjamin bahawa maklumat dalam mana-mana penyenaraian adalah lengkap, terkini, atau tepat. Apabila pemilik perniagaan menuntut penyenaraian, mereka bertanggungjawab untuk ketepatan maklumat yang dipaparkan. Dengan menuntut penyenaraian, anda menjamin bahawa anda adalah pemilik perniagaan tersebut atau diberi kuasa oleh pemilik, dan bahawa semua maklumat yang anda serahkan adalah benar, tepat, dan tidak mengelirukan.

6. Verification and the Verified badge6. Pengesahan dan lencana Disahkan

The “Verified” badge means:

• The business owner submitted verification documents (SSM certificate and/or utility bill).
• Our team reviewed those documents and confirmed the claimant's association with the listed business.

The Verified badge does NOT mean:

• That we endorse, recommend, or guarantee the quality of the business, its products, or its services.
• That the business holds any specific licence, permit, or certification beyond SSM registration.
• That we have inspected the business premises, verified its financial standing, or assessed its compliance with any law or regulation.
• That you will have a satisfactory experience with the business.

The Verified badge is a statement about identity verification only — that the person managing the listing has demonstrated a connection to the business. It is not a warranty, endorsement, or quality mark of any kind.

Lencana “Disahkan” bermaksud pemilik perniagaan telah menyerahkan dokumen pengesahan dan pasukan kami telah mengesahkan hubungan penuntut dengan perniagaan tersebut. Lencana Disahkan BUKAN sokongan, pengesyoran, atau jaminan kualiti perniagaan, produk, atau perkhidmatannya. Ia adalah pengesahan identiti sahaja.

7. Payment and subscriptions7. Pembayaran dan langganan

• The Verified Badge is available as an annual subscription.
• Payments are processed securely through Stripe. We do not store your full payment card details.
• Prices are displayed in Malaysian Ringgit (RM) and include any applicable taxes.
• 30-day money-back guarantee: You may request a full refund within 30 days of payment, for any reason. After 30 days, subscriptions are non-refundable for the remainder of the annual period.
• If your verification application is denied, any payment made will be refunded in full, regardless of how long ago the payment was made.
• We reserve the right to change subscription pricing. Existing subscribers will be given at least 30 days' notice before any price change takes effect on their next renewal.

Lencana Disahkan tersedia sebagai langganan tahunan. Pembayaran diproses melalui Stripe. Jaminan wang dikembalikan 30 hari: anda boleh meminta bayaran balik penuh dalam masa 30 hari dari pembayaran. Selepas 30 hari, langganan tidak boleh dikembalikan. Jika permohonan pengesahan anda ditolak, bayaran yang dibuat akan dikembalikan sepenuhnya.

8. AI-generated content disclaimer8. Penafian kandungan yang dijana AI

Sabah Business Hub uses artificial intelligence to generate business descriptions, translations, and search results. AI-generated content:

• May contain inaccuracies, outdated information, or errors.
• Is provided as a starting point only — business owners are responsible for reviewing and correcting their profiles.
• Does not constitute professional advice, recommendation, or endorsement of any kind.
• Must not be relied upon as the sole basis for any decision regarding a business.

First Step Creatives expressly disclaims all liability for any loss, damage, or inconvenience arising from reliance on AI-generated content on the Platform.

Sabah Business Hub menggunakan kecerdasan buatan untuk menjana penerangan perniagaan, terjemahan, dan hasil carian. Kandungan yang dijana AI mungkin mengandungi ketidaktepatan dan disediakan sebagai titik permulaan sahaja. First Step Creatives dengan nyata menafikan semua liabiliti untuk sebarang kerugian yang timbul daripada pergantungan kepada kandungan yang dijana AI di Platform.

9. Prohibited conduct9. Kelakuan yang dilarang

You agree not to:

• Claim a business listing that you do not own or are not authorised to manage.
• Submit false, misleading, or fraudulent verification documents.
• Use the Platform to harass, defame, or harm any person or business.
• Scrape, crawl, or bulk-download listing data from the Platform by automated means.
• Attempt to circumvent any security measures, access controls, or rate limits.
• Use the Platform for any unlawful purpose.

Violation of these terms may result in immediate suspension or termination of your account and listing(s), without refund.

Anda bersetuju untuk tidak menuntut penyenaraian yang anda tidak miliki, menyerahkan dokumen palsu, menggunakan Platform untuk mengganggu atau memfitnah mana-mana pihak, mengumpul data secara automatik, atau menggunakan Platform untuk sebarang tujuan yang menyalahi undang-undang. Pelanggaran mungkin menyebabkan penggantungan atau penamatan akaun anda tanpa bayaran balik.

10. Intellectual property10. Harta intelek

Our content: The Platform's design, code, brand, and AI-generated base content are owned by First Step Creatives. You may not reproduce, distribute, or create derivative works from our content without our prior written consent.

Your content: You retain ownership of photos, descriptions, and other content you submit to the Platform. By submitting content, you grant First Step Creatives a non-exclusive, worldwide, royalty-free licence to display, reproduce, and distribute that content solely for the purpose of operating the Platform. This licence ends when your content is removed from the Platform.

Reka bentuk, kod, jenama, dan kandungan asas Platform dimiliki oleh First Step Creatives. Anda mengekalkan pemilikan kandungan yang anda serahkan. Dengan menyerahkan kandungan, anda memberikan kami lesen bukan eksklusif untuk memaparkan kandungan tersebut semata-mata untuk mengendalikan Platform.

11. Limitation of liability11. Had liabiliti

To the maximum extent permitted by Malaysian law:

• The Platform is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
• We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components.
• We are not liable for:
  • Any decision you make based on information found on the Platform.
  • The conduct, products, services, or representations of any business listed on the Platform.
  • Any transaction or interaction between you and a listed business.
  • Any loss arising from inaccuracies in listing data, whether sourced from public data, AI-generated, or user-submitted.
  • Any indirect, incidental, special, consequential, or punitive damages.
  • Platform downtime, data loss, or service interruptions.
• Our total aggregate liability to you for any and all claims arising from or related to your use of the Platform shall not exceed the total fees you have paid to us in the 12 months preceding the claim. If you have not paid any fees, our total liability shall not exceed RM100.

Nothing in these terms excludes or limits our liability for fraud, or for death or personal injury caused by our negligence, as required under Malaysian law.

Setakat yang dibenarkan oleh undang-undang Malaysia, Platform disediakan atas dasar “seadanya” tanpa sebarang jaminan. Kami tidak bertanggungjawab untuk sebarang keputusan yang anda buat berdasarkan maklumat di Platform, kelakuan mana-mana perniagaan yang disenaraikan, atau sebarang kerugian tidak langsung. Jumlah liabiliti agregat kami tidak akan melebihi jumlah yuran yang anda bayar dalam 12 bulan sebelumnya (atau RM100 jika tiada yuran dibayar).

12. Indemnification12. Ganti rugi

You agree to indemnify, defend, and hold harmless First Step Creatives, its owner, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

• Content you submit to the Platform.
• Your misrepresentation of business ownership or authority.
• Your violation of any third party's rights.
• Your breach of these Terms & Conditions.
• Your use of the Platform in any manner not authorised by these terms.

Anda bersetuju untuk menanggung rugi dan membebaskan First Step Creatives daripada sebarang tuntutan, liabiliti, kerosakan, kerugian, dan perbelanjaan yang timbul daripada kandungan yang anda serahkan, salah nyata pemilikan perniagaan, pelanggaran hak pihak ketiga, atau pelanggaran Terma & Syarat ini.

13. Suspension and termination13. Penggantungan dan penamatan

• We may suspend or terminate your account or listing(s) at our discretion if you violate these terms, submit fraudulent verification documents, or engage in prohibited conduct.
• You may close your account at any time by contacting us. Closing your account does not entitle you to a refund for any subscription fees already paid (subject to the 30-day money-back guarantee).
• Upon termination, your right to use the Platform ceases. Provisions that by their nature should survive termination (including limitation of liability, indemnification, and intellectual property) will continue in effect.

Kami boleh menggantung atau menamatkan akaun anda jika anda melanggar terma ini. Anda boleh menutup akaun anda pada bila-bila masa dengan menghubungi kami. Penutupan akaun tidak memberi hak kepada bayaran balik (tertakluk kepada jaminan 30 hari).

14. Force majeure14. Force majeure (keadaan luar kawalan)

We shall not be liable for any failure or delay in performing our obligations under these terms if such failure or delay results from events beyond our reasonable control, including but not limited to natural disasters, government actions, internet or infrastructure failures, cyberattacks, or pandemics.

Kami tidak akan bertanggungjawab untuk sebarang kegagalan atau kelewatan dalam melaksanakan kewajipan kami jika kegagalan atau kelewatan tersebut berpunca daripada peristiwa di luar kawalan munasabah kami.

15. Changes to these terms15. Perubahan kepada terma ini

We may update these Terms & Conditions from time to time. When we make material changes, we will notify you by email and by posting a notice on the Platform at least 14 days before the changes take effect. Your continued use of the Platform after the effective date constitutes acceptance of the updated terms.

Kami mungkin mengemaskini Terma & Syarat ini dari semasa ke semasa. Kami akan memaklumkan anda melalui emel sekurang-kurangnya 14 hari sebelum perubahan berkuat kuasa. Penggunaan berterusan Platform anda selepas tarikh kuat kuasa merupakan penerimaan terma yang dikemaskini.

16. Governing law and jurisdiction16. Undang-undang yang mentadbir dan bidang kuasa

These Terms & Conditions are governed by and construed in accordance with the laws of Malaysia. Any disputes arising from or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Malaysia.

Terma & Syarat ini ditadbir oleh dan ditafsirkan mengikut undang-undang Malaysia. Sebarang pertikaian yang timbul daripada atau berkaitan dengan terma ini hendaklah tertakluk kepada bidang kuasa eksklusif mahkamah Malaysia.

17. Severability17. Kebolehpisahan

If any provision of these Terms & Conditions is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining terms remain in full force and effect.

Jika mana-mana peruntukan Terma & Syarat ini didapati tidak boleh dikuatkuasakan, peruntukan tersebut akan dihadkan setakat yang minimum yang perlu supaya terma yang selebihnya kekal berkuat kuasa sepenuhnya.
